These Terms govern the use of Jymtra, gym-management software provided by the operator of Jymtra (“Jymtra,” “we,” “us”) to gym owners (“you”). By logging in and using Jymtra, you agree to these Terms.
Not yet finalized: the legal entity or individual operating Jymtra hasn't been specified yet. Until it is, this document refers to “the operator of Jymtra.”
1. Description of the service
Jymtra is software for tracking gym memberships: member records, renewal dates, expiry/dues status, and a log of payments received. Jymtra does not process, hold, or transmit payments itself — it only records what a gym owner tells it happened (amount, method label, date, notes). Jymtra is not a payment processor, a payment gateway, or a party to any transaction between a gym and its members.
2. Accounts and access
There is no public sign-up. A Super Admin creates each gym owner account directly and provides the owner with login credentials and a one-time activation code out of band (phone, WhatsApp, email, or in person). Each gym gets exactly one owner account. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. If you suspect your account has been compromised, contact the Super Admin using the phone number, WhatsApp, or email your gym administrator used when they set up your account immediately.
3. Your responsibilities as a gym owner
You are the one deciding what information about your own gym's members to enter into Jymtra, so you're responsible for:
- Having an appropriate basis for collecting and storing that information, and being transparent with your members about it
- Entering member information accurately, to your own knowledge
- Only uploading photos you have the right to use (e.g. of your own members, with their awareness)
- Using Jymtra only for legitimate gym-management purposes
- Not attempting to access another gym's data or bypass Jymtra's access controls
4. Acceptable use
You agree not to:
- Use Jymtra for any unlawful purpose
- Attempt to access, probe, or interfere with another gym's data or account
- Attempt to bypass authentication, rate limiting, or any other access control
- Upload content you don't have the right to upload, or that is unlawful or abusive
- Interfere with the normal operation of Jymtra for other gym owners
5. Payments and financial records
Every payment amount, receipt number, and dues calculation shown in Jymtra reflects data the gym owner entered — Jymtra does not independently verify that a payment actually occurred, and is not responsible for discrepancies arising from inaccurate entries. Jymtra's records are a convenience for the gym owner and are not a substitute for the gym's own accounting, tax, or bookkeeping obligations.
6. Intellectual property
Jymtra's software, design, and branding belong to the operator of Jymtra. You retain ownership of the member data, photos, and other content you enter into Jymtra; you grant the operator of Jymtra the limited right to store and process that content solely to provide the service to you.
7. Service availability
Jymtra is provided on a best-effort basis. We do not guarantee uninterrupted or error-free operation, and no specific uptime commitment or service-level agreement is made. Planned or unplanned downtime may occur.
8. Backups and data recovery
The operator maintains periodic, self-managed backups of the database and stored photos as a disaster-recovery measure. Backups are a safety net, not a guarantee — no specific recovery-point or recovery-time objective is promised, and you should not treat Jymtra as your only copy of information that matters to your business. Restoring from a backup, if ever needed, is a manual process performed by the operator.
9. Security
We take reasonable, documented steps to protect your data (see the Privacy Policy's Data Security section), but no online service can be guaranteed perfectly secure. You're responsible for keeping your own login credentials confidential.
10. Suspension and termination
The Super Admin may suspend a gym's access — for example, for a billing issue, suspected misuse, or a violation of these Terms. A suspended gym owner cannot access their dashboard or perform gym-management actions until reactivated. Data belonging to a suspended gym is retained, not deleted, unless deletion is separately requested (see the Privacy Policy's Data Retention and Deletion section).
11. Disclaimers
Jymtra is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Membership status, dues, and expiry calculations are provided for convenience and should be independently verified for anything financially or legally significant.
12. Limitation of liability
To the fullest extent permitted by law, the operator of Jymtra will not be liable for any indirect, incidental, or consequential damages arising from your use of Jymtra, including loss of data, revenue, or business, even if advised of the possibility of such damages. Nothing in these Terms is intended to limit liability in ways not permitted under applicable law.
13. Changes to the service or these Terms
Jymtra's features and these Terms may change over time. The “Last updated” date at the top of this page reflects the current version. Continued use of Jymtra after a change means you accept the updated Terms.
14. Governing law
Not yet finalized: a specific governing-law and jurisdiction statement hasn't been chosen yet — this is a legal decision for the operator of Jymtra to make, ideally with a lawyer's input, rather than one this document should guess at.
